Hello,

Thank you for contacting PokerStars regarding this issue.

You may have seen or heard news concerning the current discussion

about the efficacy of current gaming laws in Germany, about the

draft of a new gaming law and about the new gaming law in

Schleswig Holstein, which is in effect since 01.01.2012. You may

be interested, in how those new regulations and discussions will

be affecting the service of PokerStars. To ensure that you

receive comprehensive and accurate information, we would like to

update you on the situation.

Following a ruling by the European Court of Justice from 8

September 2010, the current German protectionist and monopolistic

gaming market contravenes the European law. The federal states

have since been encouraged to draft a gaming regulation for

Germany that is compliant with EU law.

So far only the state Schleswig-Holstein did create a new law.

The new law by the state of Schleswig-Holstein was passed on

14.09.2011 and came into effect by 01.01.2012. The new law has

been reviewed already by the European Commission and found to be

compliant with the EU law. According to this law online poker

websites like PokerStars can apply for and ultimately obtain a

German licence (since 01.03.2012). PokerStars is just in the

process to apply for such a license. With the license, PokerStars

will be operating a .DE domain in the future. First of all, this

is necessary for tax purposes, as German players can be recorded

with this license and PokerStars will pay tax in Germany for

their play. But this will not be a closed German system. German

players will still be able to play international and to compete

with players all around the world.

There is a second draft law of all other federal states which is

facing the gaming law of Schleswig-Holstein. The second draft law

is aiming to partly liberalise (Online) Sports Betting. The first

draft (which does not differ highly from the second one) has

already been found as not compliant with the EU law by the

EU-Commission. Mainly, because the amount of Sports Betting

Licenses is restricted and (Online)Poker Licenses are not

designated at all. It remains to be seen what will happen in this

situation. In fact, at the moment there is no accepted

Interstate Lottery Treaty by the EU-Commission but there is an

accepted gaming law for the state Schleswig Holstein.

Furthermore, there are intense discussions about whether poker

should even be considered a game of chance - as German gaming

laws and especially the Interstate Lottery Treaty would only

apply to poker in this case. There are however multiple

scientific studies which have found that poker is a game of

skill. Moreover, foreign courts (e.g. in Sweden or the

Netherlands) have come to the conclusion that the game of poker

is dominated by skill. Italian courts have also confirmed our

notion: poker is regulated as a game of skill there.

Due to Schleswig-Holstein's pioneering role and the clear

statements made by the EU commission regarding this issue, we are

confident that a reliable legal regulation will be found for the

more than four million online poker players in Germany.

In any case, we will continue to closely monitor any developments

on the issue and we are in constant contact with German lawyers

to ensure that we can provide our customers with up-to-date

information about possible changes in regards to this situation.

Finally, we wish to emphasise that PokerStars will continue to

provide you with a safe and secure gaming experience, as well as

the highest level of security for your deposits. You are more

than welcome to continue to play and enjoy poker with PokerStars.

As usual, should you have any further questions, please do not

hesitate to contact us at support@pokerstars.com.

Regards,

Gilles G.
